Truth only happens one time and it is gone forever. Until we create a time machine to go back and create what the truth really was, we will never know, and all we have is the ability to recreate it.
These cases do not occur in boilerplate fashion. As a result, they require an investigative technique that allows them to be recreated in a way that the jury can understand it in all of its dimension and all of its degrees. We do that through video techniques, animations, models. We do it through testimony. Sometimes we do not have access to the original location so we have to mock up a model for purposes of recreating what had occurred. We have been very successful, I think, in taking a scene that, of course, had happened much earlier in a completely different environment and letting the jury feel that they are there.
“I am just going to pull the screen out and take a look at the hardware. When we look at the hardware we can see…. “
We find it very challenging to recreate a complicated case for the benefit of the jury so that they can see it almost as if it was happening.
I think preparation is the absolute hallmark to a successful conclusion.
